AI Chatbot Terms and Disclosure

This page explains the terms that govern your use of the Armadillo Tough AI Assistant (the “AI Assistant”), what data we collect when you use it, and your rights. By using the AI Assistant, you agree to the terms below. If you do not agree, please do not use the AI Assistant. You can reach our human team at help@armadillotough.com or by phone at 888.350.7306.

1. You Are Chatting with a Bot, Not a Human

The AI Assistant is an automated software program, or “bot,” powered by artificial intelligence. It is not a human representative of Armadillo Tough. In accordance with California Business and Professions Code § 17940 et seq. (the California Bot Disclosure Law), we are disclosing this to you clearly and conspicuously: you are interacting with a bot.

If at any time during your conversation you would prefer to speak with a human, type “agent” or “human” in the chat, email us at help@armadillotough.com, or call 888.350.7306 during business hours.

2. Limitations of the AI Assistant

The AI Assistant uses artificial intelligence to generate responses. While we work to make it helpful and accurate, you should understand that:

  • The AI Assistant may make mistakes. AI-generated responses can be incorrect, incomplete, or out of date. Do not rely on the AI Assistant for decisions that have legal, financial, medical, or safety consequences.
  • The AI Assistant is not authorized to make binding commitments. Statements made by the AI Assistant about pricing, availability, warranties, shipping, returns, or any other terms are not binding on Armadillo Tough unless confirmed in writing by a human representative. Our official terms are governed by our Terms of Use and the order confirmation you receive at purchase.
  • The AI Assistant does not provide professional advice. It cannot provide legal, financial, engineering, structural, electrical, or other professional advice. Garage construction, electrical, and structural work should be reviewed by licensed professionals.
  • Product configurations are illustrative. Any product recommendations, dimensions, or configurations suggested by the AI Assistant are estimates. Final fit, dimensions, and suitability for your space must be confirmed via our Free Design Studio or with a member of our team before purchase.

3. Third-Party AI Processing

The AI Assistant is operated by Interactor.ai, a third-party artificial intelligence service provider. When you chat with the AI Assistant:

  • Your messages and our responses are transmitted to and processed by Interactor.ai.
  • Interactor.ai acts as our Service Provider under the California Consumer Privacy Act and is contractually restricted from using your information for purposes other than providing the chatbot service to Armadillo Tough, except as described below.
  • Conversations are retained for 90 days in active systems before deletion.
  • Interactor.ai uses chat conversations to train and improve its AI models. This use is described in greater detail in our Privacy Policy. If you do not consent to this use, do not use the AI Assistant.

4. Information We Collect Through the AI Assistant

When you use the AI Assistant, we and Interactor.ai may collect:

  • The contents of your messages and our responses
  • Your IP address, browser type, device type, and approximate geographic location
  • The page on our site where you initiated the chat
  • A session identifier and timestamps
  • Any information you voluntarily share during the conversation, including your name, email, phone number, address, or product preferences

5. Do Not Share Sensitive Information

Please do not share sensitive personal information in the AI Assistant. This includes:

  • Social Security numbers, driver’s license numbers, or other government identifiers
  • Payment card numbers, bank account numbers, or other financial account credentials
  • Passwords, security questions, or authentication codes
  • Health information, medical conditions, or insurance details
  • Information about minors under the age of 16
  • Precise geolocation data
  • Any other category of sensitive personal information as defined under California Civil Code § 1798.140(ae)

If you accidentally share sensitive information, contact us at help@armadillotough.com to request deletion. We will use commercially reasonable efforts to remove the information from our systems and request removal from Interactor.ai’s systems within 30 days.

6. Your Consent

By using the AI Assistant, you acknowledge and agree to the terms set out on this page and in our Privacy Policy. Specifically, by sending a message to the AI Assistant, you confirm that:

  • You understand you are chatting with a bot, not a human
  • You consent to the transmission and processing of your messages by Armadillo Tough and Interactor.ai
  • You consent to the retention of conversation data for 90 days
  • You consent to Interactor.ai’s use of conversation content to improve its AI models
  • You consent to the recording, storage, and review of your conversation as described below
  • You are at least 16 years of age
  • You will not share sensitive personal information through the AI Assistant

Our Privacy Policy and these terms are linked from our website footer and from the cookie consent banner that appears on your first visit to armadillotough.com. By accepting cookies through that banner and proceeding to use the AI Assistant, you confirm you have had the opportunity to review these terms before engaging with the AI Assistant.

How to Decline These Terms

If you do not agree to any of the terms on this page, do not use the AI Assistant. You can reach our human team instead by:

Closing the chat window without sending a message means you have not consented and no conversation data is retained beyond technical session information.

Withdrawing Consent

You can withdraw consent at any time by:

  • Clicking “Do Not Sell or Share My Personal Information” in our website footer
  • Enabling Global Privacy Control (GPC) in your browser
  • Emailing help@armadillotough.com with the subject line “Withdraw Chatbot Consent”

We will delete your conversation history from active systems within 30 days and request deletion from Interactor.ai. Withdrawing consent will make the AI Assistant unavailable to you on subsequent visits. You can continue to receive support through our human team.

Scope and Duration of Consent

Your consent applies to the current chat session and any subsequent sessions from the same device or browser until you withdraw it as described above. We do not retain consent across devices. If you use the AI Assistant from a different device or browser, you will consent again at that time by sending a message.

Future Updates

We are in the process of implementing an in-widget consent screen that will appear before your first chat interaction and require an explicit click to proceed. Until that screen is live, your consent is established by your decision to send a message to the AI Assistant after having access to these terms and our Privacy Policy.

7. Your Rights Under California Law

If you are a California resident, you have the following rights regarding your AI Assistant data:

  • The right to know what personal information we have collected about you through the AI Assistant
  • The right to delete your conversation history
  • The right to correct inaccurate personal information
  • The right to limit the use and disclosure of sensitive personal information
  • The right to opt out of the sale or sharing of personal information for cross-context behavioral advertising
  • The right to non-discrimination for exercising any of these rights

To exercise any of these rights, email help@armadillotough.com or use our request form at armadillotough.com/pages/support#contact. We will respond within 45 days as required by California law.

8. Your Rights Under Other State Laws

Residents of Virginia, Colorado, Connecticut, Utah, Oregon, Texas, Montana, and other states with comprehensive privacy laws have similar rights. See our Privacy Policy for state-specific information.

9. Recording, Monitoring, and Your Consent to Recording

What We Record

When you use the AI Assistant, the complete contents of your conversation, including every message you send and every response the AI Assistant generates, are recorded, stored, and may be reviewed by Armadillo Tough personnel and by Interactor.ai. Recording begins the moment you send your first message and continues for the duration of your session.

In addition to message content, we record:

  • Timestamps of each message
  • Your IP address and approximate geographic location
  • Your browser type, operating system, and device type
  • The page on our website where the conversation was initiated
  • A session identifier that links your conversation to your browsing session

Why We Record

Recordings are used for the following purposes:

  • Operating the AI Assistant
  • Quality assurance and improvement
  • Training and improvement of AI models by Interactor.ai
  • Customer support and dispute resolution
  • Fraud prevention and security
  • Legal compliance

Retention

Conversation recordings are retained in active systems for 90 days from the date of the conversation. After 90 days, recordings are deleted from active systems. We may retain anonymized, de-identified versions of conversation data for longer to analyze trends and improve our service.

If a conversation is connected to an actual or anticipated legal claim, an active investigation, a dispute with a customer, or a regulatory inquiry, we may retain that specific conversation beyond 90 days for as long as reasonably necessary to address the matter.

Your Consent to Recording

California Penal Code § 632 and similar all-party consent laws in several other states require that all parties to a recorded electronic communication consent to the recording. By using the AI Assistant, you provide that consent.

  • Notice of recording: A persistent disclosure banner is displayed at the top of the AI Assistant widget at all times, stating that conversations are recorded and processed by Interactor.ai.
  • Consent through use: By sending any message to the AI Assistant after viewing this disclosure, you affirmatively consent to the recording of the entire conversation.
  • Right to decline: If you do not consent to recording, do not send any message to the AI Assistant. Close the chat window and contact our team through another channel.
  • Continued consent: Each time you initiate a new chat session, you renew your consent to recording by sending a message.

Recording by Interactor.ai

Interactor.ai records and processes your messages on our behalf as our Service Provider. Interactor.ai’s recording is contractually limited to the purposes described in this page. Interactor.ai is contractually prohibited from using your conversation content for any purpose other than providing the chatbot service to Armadillo Tough and improving Interactor.ai’s AI models as disclosed above.

Notice for Residents of All-Party Consent Jurisdictions

If you are located in California, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, Washington, or another jurisdiction that requires all-party consent to record electronic communications, please be advised that your continued use of the AI Assistant after viewing the disclosure banner constitutes your affirmative consent to the recording of your conversation under the applicable statute, including California Penal Code § 632.

If you do not consent, do not use the AI Assistant.

Sharing of Recordings

Conversation recordings may be shared with:

  • Interactor.ai
  • Armadillo Tough personnel with a legitimate business need
  • Service providers who help us operate our business
  • Law enforcement, regulators, or courts in response to lawful requests
  • Successors in interest in the event of a merger, acquisition, or sale of business assets

Recordings are not sold to third parties for advertising purposes.

10. Prohibited Uses

You may not use the AI Assistant to:

  • Attempt to identify, reverse-engineer, jailbreak, or manipulate the underlying AI model
  • Generate unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content
  • Generate content that infringes intellectual property rights or violates the privacy rights of others
  • Submit automated queries, bots, scripts, or scrapers without our prior written consent
  • Attempt to extract Armadillo Tough’s confidential business information, supplier lists, pricing strategies, or training data
  • Use the AI Assistant in any way that violates applicable law

We reserve the right to terminate your access to the AI Assistant at any time, with or without notice, for any reason or no reason.

11. Intellectual Property

All content generated by the AI Assistant, including text, recommendations, and responses, is provided to you for your personal, non-commercial use related to potential or actual purchases from Armadillo Tough. You may not reproduce, distribute, or use AI Assistant output for commercial purposes, training of other AI systems, or competitive analysis without our prior written consent.

Armadillo Tough retains all rights, title, and interest in the AI Assistant, its underlying technology, and its outputs.

12. Disclaimer of Warranties

THE AI ASSISTANT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ARMADILLO TOUGH AND INTERACTOR.AI DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

ARMADILLO TOUGH DOES NOT WARRANT THAT THE AI ASSISTANT’S RESPONSES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. ANY RELIANCE YOU PLACE ON THE AI ASSISTANT’S RESPONSES IS STRICTLY AT YOUR OWN RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARMADILLO TOUGH AND INTERACTOR.AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE AI ASSISTANT, EVEN IF ARMADILLO TOUGH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ARMADILLO TOUGH’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE AI ASSISTANT WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO ARMADILLO TOUGH IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Armadillo Tough, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the AI Assistant in violation of these terms or applicable law.

15. Changes to These Terms

We may update these terms at any time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the AI Assistant after changes are posted constitutes your acceptance of the revised terms. If you do not agree to the revised terms, stop using the AI Assistant.

16. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute arising out of or related to these terms or your use of the AI Assistant will be resolved in accordance with the dispute resolution provisions of our Terms of Service, including any arbitration agreement and class action waiver contained therein.
